Yesterday Mr Whitofoord, R.M., gave judgment in an aotion brought by the Government to recover £24, part of the cost of unresting and detaining tho Roy. W. Radcliffe at Adelaide at the instigation of his creditors. Mr Martin, for tho Government, contended that the creditors were liable for such costs. Mr Gresson, for tho creditors, argued that the greater potion of the expenses had been caused by tho blundering of the authorities in Adelaide. The Bench was of opinion that tho £13 incurred in remanding and re-arresting Radcliffo was incurred through tho mismanagement of the authorities in Adelaido, and was not chargeable to the defendants. On the other hand, the items amounting to £11, including legal advice to Constable Stunner, were fairly chargeable to the defendants as representing the. creditors. Judgment for that amount, and costs of Court.
