A PECULIAR CASE.
Tliu civil ciiMi of George Dewes v. Louis Lew came on for bearing at the Court this utoriiiinir. Mr Dick appeared for the plaintiff, uiid Mr Lasoellcs for the defendant. Hi- Dick said this case was v. rather interesting one about a horse—they generally were —but this one wan peculiarly interesting. The plaintiff exchanged horses with the defendant, and afterwards found out that tho horse was the property of another man, the hnrse being alleged to have been stolen, and plaintiff sought to get possession of his own horse.
George Rymer deposed he had at the present a mare, which wit.s his property. Had her for several years. Lust her in December, I.HBIS, and hunted miles torecover her. At length found the inure in the possession of Mr Dewes and claimed her ' The horse was. lost for twelvemonths. George \V. Dewes deposed he exchanged horses with tho defendant. H.id to give the horse up. When he came down to Oiutthu Mr Rymer's coach-driver recognised the horse, and said it belonged to Mr Rymer Asked him vrliether he was sure it was the horse. The driver said ho was certain, and told him that he would leave the horse at Beecroft's stables to be called for. Afterwards wrote to Mr Levy claim■jug the horse. . Cl.arl™ Palmer deposed he knew the horse, it belonged to Mr Rynior. Had often seen it in hU .-'tables. Louis Levy deposed J;e gut the horse from a man named McKouxio, who was a navvy up the lino. Counsel having , addressed the Court, the R.M. said he would reserve judgment to consider the various points raised by counsel. He would give judgment on Tuesday next.
