(Before His Honor Sir James Prendergast and a special jury.) .. The case of W. B. Scott v. Borough of Hastings was continued- after wo went to press yesterday afternoon. W. B. Scott continued : Sometimes ho had to put in concrete thicker than that specified in carrying out the work. By such thicker work "being: put in the cement cost him nothing, it was howover worth 13s per cubic yard for the extra .excavation and the cost of mixing and placing the additional " concrete, When he came to Napier had with him about £900 for purposes of the work; on July 27th was overdrawn at the bank. Very little money was sent away by him, but had obtained from the Board £2875, which made- a total expenditure of £3775. The amount of, the .contract was £4995, and by. the contract, having been taken from him thought he, lost £3760. . Owed £147 when he left Napier ; that might be added to the expenditure in connection with the contract. Made ho . profit whatever. There was at least £363 worth of timber on the ground, but he only charged half that sum. If he was allowed £100 for, the timber would not think that he had been well treated. Authorised the Board to pay moneys on his behalf after the 27th July. To Mr Harper : Never knew the work to have been delayed for want of timber. Saw 13 chains of the work excavated and timbered after the contract was taken from him, but when he was at the work Mr Rochfqrt only allowed him to open two chains at a time. When ho was on the work never used any tallow or fat; his foreman, might have used some. The claim for tallow supplied to the Board was.£7 9d. The Board claimed to have paid on his* account £394 Is Bd,. blithe only admitted £166. .The wages' given to themen were allowed for'in his estimate of what it should have cost to complete the work after the contract had been taken from him. . The' Court then adjourned until next morning.
