PECULIAR CASES.

Tijiaru, This day

A curious case arose at the Supreme Court yesterday. A special jury case came on, the amount claimed being £-100. All the jurors, witnesses, etc., had been in attendance two days, but on the case being called, Mr Joynt, who appeared for the plaintiff, contended that U3 no order had been made for a special jury of twelve the case could not be tried by them, as the case did not exceed £500. The point was held fatal, and the case was adjourned sine die. There was naturally a great deal of dissatisfaction expressed by the special jurors and witnesses havingbeen summoned, and such a glaring error made. The case of Hayhurst v. Matthews and Tresizo closed last evening, a general verdict being given for defendants. An interesting point arose in the case. Ono of tho covenants of a lease was that three consecutive corn crops should not be taken off the land. The evidence of several experts and lengthy arguments were heard as to whether the lessor intended by this covenant to forbid the sowing of a third crop of wheat, or whether to merely forbid the growing maturity of the third crop ? Did the grain crop mean turnips, rape, potatoes, beans,'etc., or could an immature crop be so described. The opinions were divided, but as the defendants had cut the third crop when in an immature state tho jury found for them.
