At the AVaipawa Magistrate's Court yesterday, before H. AVilding, Esq., J.P., T. Fitzgerald was brought up in custody, on remand, charged with the larceny of a mare, the property of H. McGreeA-y, on the 22nd of September last. The circumstances connected Avith this case have been previously reported. Mr Lee appeared for the prisoner (who was undefended at the first hearing), and ably revieAved the evidence taken, urging that there was not the shadow of a case for a jury. His Worship said that, having given the case deep consideration, he Aviis induced to concur in the remarks of prisoner's counsel as to a true bill being found if prisoner were committed. Tho case would therefore be dismissed.
