This Day,

(Before Captain Preece, E.M.) FUHIODS RIDING. Thomas Monk was charged with furious riding at Waipavva on the 27th October. Mr Guy, for the defendant, pleaded that the charge was laid under the wrong Act, and the case was dismissed. ASSAULT. A lice MacfarJane charged John Herbert with committing an unlawful ascault upon her at Wainui on the Bth October. The plaintiff deposed that she was a cook at Herbert's. At about 7 o'clock on the evening of the Bth Herbert came and caugbt witness by the throat and knocked her down, kicked her on the hip, and also scratched her face. She bad done nothing to cause Herbert to treat her so. On being cross-examined by Mr Lascelles, who appeared for the defendant, she admitted that she took a knife and threatened Herbert if he hit her again. She was not drunk, but had been drinking gin. She gave no provocation. Herbert, big wife, aod a witness, proved that the plaintiff wae drunk and

waa using beastly language, and that plaintiff asked her to go to her bedroom. She would not, co Herbert gently forced her there. When inside the bedroom she struck Herbert with a knife, cutting his thumb. The Bench dismissed the charge without costs, as Macfarlane had no witnesses to support the charge, and it was also proved that she was very drunk. His Worship said the evidence did not show very creditable scenes in a public-house on a Sunday. CIVIC CASES. Mullinder v. Wilson.—Claim £12. The case was adjourned from last Court day to allow plaintiff to produce an agreement between himself and Hayden, his late manager at the Waipawa Hotel. The agreement was now produced, and iudgment was given for plaintiff, with costs. Alice MacFarlane v. John Herbert.— Claim, £8 79 6d for wages. Mr Lascelles appeared for the defendant, and judgment was given for the defendant, with costs £l 10s, witnesses expenses 12s, and counsel's fee 20.

Several other cases were settled out of Court, in some the summonses had not been served, and others were withdrawn.
