Vagrancy. — James Gilmore", alias Janies Galbraith, was charged with having no lawful or visible means of support, and pleaded not guilty. — Mr. Commissioner Naughton, who prosecuted, stated to the Bench that he might have brought up the prisoner on the more serious charge of attempted robbery, which would compel thd case to be taken into the Supreme Court ; but, as one of the principal witnesses would be a Marine, and he would have to leave with the Squadron, he had therefore confined himself to the charge of vagrancy.— Edward Warfoll, a gasfitter, deposed that on Sunday morning, about eleven o'clock, he saw the prisoner on the Barrack Green with his hand in the pocket of the Marine, and. as he could not give a proper account of his conduct he gave him in charge. — Mr. Naughton proved two former convictions of larceny against the prisoner, and the Bench sentenced him to three months' imprisonment with hard labour. [J. Naughton, Esq., J.P., here joined the Bench.] Neglecting to Burn Lights at Sea. — Captain Cooper, master of the barque ' Kate,' wa3 charged with this offence while on the passage from Sydney to this port, and pleaded guilty. — Mr. Brooktield, who appeared on behalf of the Postmaster, did not wish to press for a heavy penalty, but as a caution. — The Bench inflicted a fine of 55., costs and fees of solicitor to be paid by defendant. The Court then rose.
