POLICE COURT.— Friday. [Before T. Beckham, Esq., R.M.]
BKEAOa 07 DEBTORS AND CREDITOKS ACT, 1862. Marcoau Hautrive was brought up on three different charge* of fraud under the above Act, at the instance of Mr. Henry Vernon, sequeatrator of the •state. Mr. Brookfield said he appeared for the prosecution, and had to inform the Court that it was impossible to obtain the attendance of a. material witneis in the case, named Holloway, who was in the employment of the accused. Under those circumstances he would withdraw the charges. His Worship informed the prisoner that counsel for the prosecution was not prepared to proceed against him in the absence of a material witness, and that, therefore, the whole of the charges were withdrawn and the sureties discharged. The prisoner was then discharged.
EDMUND J. COX. E. J. Cox was formally remanded until Monday on the charges of larceny and forgery. Mr. Wynn and Mr. Beveridge appeared for prisoner, and expressed a hope that the case would be heard on Monday. His Worship said the case would be proceeded with on Monday, as a number of subpoenas had been served requiring the attendance of witnesses on th&t day.
EMBEZZLEMENT. Jesse Cole was brought up on remand, charged with embezzling two sums of money, £1 8s and £1 13s. 10d., received by him on accouut of Mr. Henry J. Wadham, wharfinger, in whose service he was employed as clerk. Mr. Macdonald appeared for the prosecution, and asked for a remand. Mr. Wynn appeared for the prisoner, and acquiesced in the application. The prisoner was remanded until Friday next, the bail being enlarged until that time. There were no other cases before the Court.
