CITY BOARD OF COMMISSIONERS. DRAKE-STREET AGAIN.
A special meeting of the City Board of Commissioners was convened by circular on Saturday, to consider certain correspondence with reference to the Drake-street improvements between the secretary and the solicitor to JVI r. Hosie. The followiug is the correspondence :—: — " Wyndham Chambers, April 6, 1867. "Sir, — I hare the honour to acknowledge the receipt of your letter of the otb instant, and in reply thereto beg to state, that Mr. Rosie will not make any objection to the Board of Commissioners carrying on the works in Drake-street to the extent mentioned in your letter, and bhat no steps will be taken to enforce the injunction obtained in Kosie v. Bain and others, bo long as the Board confine their operations within the limits specified in your letter. " Mr. Gillies and myself stated on the occasion you mention that we would not object to the works being carried on so far as the building of the culvert was concerned, but you are slightly in error in stating that we said the injunction did not apply to the portion of Drake-street mentioned by you.— l hare, &c, ' J. MacCormick. " J. Ogilvie, Esq., Secretary."
" City Board of Commissioners' Office, " Queen-street, April 5, 1867. " Sir, — I have the honour to inform you that it is the wish of the Board that the portion of the works in Drake-street extending from the Freeman's Hotel towards the city, as shown on the plan of the works signed by the contractor, should be proceeded with, so far as regards the completion of the culvert, the building of the sea wall, and the filling up of such portion of the embankment, as shown on the plan, a8 may be considered necessary, in order that tbe safety of the public may thus far be protected, and the works already carried out be prevented from sustaining material damage. " When the hearing upon the interim injunction, obtainedaat the instance of Mr. Bosie, took place, both Mr. Gillies and yourself were quite willing that the Board should proceed with the portion of the works referred to, as he and you considered that the injunction did not apply to that portion of the roadway. "Before proceeding with these works, however, the Board consider it necessary that you should state, in writing, that they will not be iv any way interfering with the interim injunction obtained by Mr. Kosie, and that you have no objection to their so proceeding with the portion of the works referred to. The Board are to meet specially to-morrow (Saturday), at 12 o'clock, to take the matter into consideration, |and it will be obliging if you let me have your answer before that hour. — I have, &c, "J. Ogilvib, "Secretary, " J. MacCormick, Esq., u Solicitor for Mr. Rosie." On the proposition of Mr. George the meeting was adjourned until two o'clook to-day, owing to the absence 6f member.
