Asia nit Case. William. Buckland charged with assault. S. E. Hughes sworn : I reside in Auckland, was present at polling place, at Newmarket, on Saturday, May S, as chief del k for Mr. D. Graham. Shortly after nine o'clock, defendant, who had previously voted, came into polling room, laid down a voting paper befoie the deputy leturning officer. I -»took up the voting paper arid said "this is not your paper, and the man whos" name is to it, has already recorded his vote, and it' he bud not he (Mr. 3.) had not a right to hand it in." Defendant demanded the loting paper which I refused to give. The man whese name was on the paper came into the room about tho time I took up the paper. Defendant n^ked nit for it in a very excited manner. I tore it uy. refusing to give it to him. I was making a lemaik that he had no right to take advantage of the state the man was in, in older to induce him to vote a second time. Defendant then stiuclc me a \iolcntblow knocking my head back against thepmtition, at the same ti;ne '■Aying "I will knock bloody Hell (!) out of you, or any boiiv el->e that opposes me. Pefen 'ant was much eti'iuvl and after inteifeience by Ddputy Returning Officer left the polling booth. Ciups-ex nnined. The pei son whose paper the dispute w as ibout was named John Maim, he followed defendant i.ilo polling room. Did not accuse defendant of endeavouring to persuade a person to vote twice. John Mairn's \ote was afterwards taken. Cant swear that the Returning Officer did no t demand the voting paper ii om me. Did not hear him ask me. The word that I understood was "oppose." I dont think it possible that the word "accuse" could have been used instead. Captain Bobbins : was Deputy Returning Officer, at Newmarket, on Saturday last, conoborated last witness, statement. Defendant thioatened to knock any bodys head oft" who accused him. Patrick Madifjan and Thomas Craig both gave evidence to same effect. Fired £5 and costs.

John Campbell charged Thomas Parker with assaults. Complainant was not cognisant ot assault, was only told of 'it. Mary Byrnes called by Mr. Campbell to prove the case, said she knew nothing about any assault. Case dismissed.
