Land Sales Court Asked For Definition

(By Telegraph.—Press Association.) NEW PLYMOUTH, July 24. Legal definition of the Avords “undue aggregation” Avas sought in the Land Sales Court at New Plymouth today when the Court heard an appeal in respect .'of the sale of land at Cardiff. Counsel submitted interpretations of the wording which they considered met the intention of the legislation, but admitted that they faced a difficulty in vieAV of the lack of any previous decision to guide them.

Mr. Justice Finlay, who reserved decision, said it Avas the first time the Court had been asked to give an opinion on the section of the Servicemen’s Settlement and Land Sales Act referring to undue aggregation. Perhaps, he added, the expression Avas of the kind one expected to find in legislation that Avas neAv. Appellant was R. J. Smith, Avho had been refused approval for the purchase of 314 acres by the Taranaki Land Sales Committee. He already oAvned 119 acres about a mile from the property in dispute. Smith’s counsel submitted that the bind had been refused by the Crown for the settlement of ex-service-men and it was in the public interest that the property should be cleared oi ragwort and turned into a valuable farm. The prospective .purchaser would be able to do that.
