DAMAGES CLAIM
Verdict Reversed At Second Trial
Dominion Special Service.
PALMERSTON N., February 5.
At the July sittings of the Supreme Court in Palmerston North. Jack William Dansby, iipholsterer. Palmerston North, claimed damages from Gough. Gough and Hamer. Ltd., as the result of :t collision io Main Street betweu plaintiff's motorcycle and a motor-lorry owned by defendants. A verdict for plaintiff was •pven and defendants applied for a new Prial. This "’as dismissed by the Judge, who entered judgment for plaintiff. Against this dismissal defendants appealed to the Court of Appeal, which ordered a new trial, this taking place in the- Supreme Court yesterday. Mr. Justice Ostler presided. Mr. M. H Oram appeared for plaintiff mid Mr. H. ]{. Cooper for defendants. 'l'he claim was lor £1250 general damages mid £451 /IS/- special damages. After evidence had been heard throughout the dav the jury found defeiidmit company not guilty of negligence mid plaintiff giiilt.v of negligence contributing to the a’eeitlent. A motion for judgment for defendants was reserved in the meantime.
