APPEAL DISMISSED

The Court of Appeal, comprising the Chief Justice (Sir Michael Myers), Mr. Justice Blair, Mr. Justice Kennedy, and Mr. Justice Northcroft, dismissed the appeal of the Australian Mutual Provident Society, the Colonial Mutual Life Assurance Society Ltd., and the State Fire Insurance Office, against a judgment by Mr. Justice Johnston granting an application by the Public Trustee to swear to the death of William Alfred Joseph Suiter Montgomery, baker, of N’gatea, Thames, who disappeared on February 3,193 G. The missing man was was insured for about £3OOO with the companies concerned. Mr. Justice Blair dissented from the judgment.
