Claim By Hawera Woman
The Court of Appeal yesterday heard an appeal from the judgment ol Mr. Justice Ostler dismissing a motion asking that a jury’s verdict be set: aside ami a new trial ordered in the New Plymouth ease in which Susan Biggs, spinster, Ttawera. failed in her claim against George Edward Woodhead, truck-driver. Okaiawa, for £5OOO general damages ami £62 special damages. In the Supreme Court trial in New Plymouth the jury had found for defendant, Woodhead, and judgment was entered for him with costs Miss Biggs was a passenger in the car of her employer, Christian Stampa, farmer, Okaiawa, on October 13, 1938. when a collision occurred on the Normanby Road with Woodhead’s lorry. Miss Biggs received a compound fracture of the skull and brain injury and her left, arm had to be amputated above the elbow. .Mr. M. J. Burns ami Mr. Dewart represented the appellant, Miss Biggs. Mr. L. M. Moss and Mr. I’. Gray represented respondent, Wood h end. 'rhe case is proceeding.
