AN ORGANIZER’S CLAIM
Plaintiff Asks For Nonsuit
A claim against the National Party for salary alleged to be due and for £2OO damages for alleged wrongful dismissal was made in the Magistrates’ Court, yesterday, by John .McCarthy Power, organizer. The action was brought before Mr. J. H. Luxford, S.M., Mr. Hardie Boys representing the plajntiff and Mr. O. C. Mazengarb and Mr. S. G. Stephenson appearing for the defendants. The hearing of the case commenced in the morning, when the plaintiff was called. When the Court resumed after lunch Mr. Boys said he had very carefully considered with 'the plaintiff the view which his Worship had expressed on two occasions regarding the hearing concerning the position in law. He was satisfied that in law the claim was not tenable and should not be proceeded with. Therefore he would ask for a nonsuit.
Mr. Mazengarb claimed that plaintiff had been very generously treated. The magistrate granted the application for a nonsuit and ordered plaintiff to pay legal costs amounting to £l9/4/-, and Court costs £3/17/-.
