Claims For Commission On Sales Succeed CONFLICT OF EVIDENCE Dominion Special Service. HASTINGS, June 19. Claims for commission by William 'Tucker, company manager, Clive, and Reginald Bercy Wilder, Wallingford, against Albert Edward Davy, sharebroker lor the "Hawke’s Bay Daily Mail,” were the subject of reserved decisions delivered by Mr. J. Miller, S.M., iu the Magistrate’s Court, Napier, today.. Both plaintiffs were successful. Eaqh claimed that Davy had promised him commissions ou certain shares in the “Hawke’s Bay Daily Mail” sold with their assistance. Tucker, who claimed a total of £231/10/-, was awarded £228. Wilder was awarded £47/10/-. Referring to a direct, conflict ot evidence iu the Tuclyer case, tlie magistrate said in his judgment: “Witnesses for plaintiff are prominent and reputable people in Hawke’s Bay. Their definite statements, if false, would amount to perjury, and on two occasions to conspiracy to defraud defendant. I accept their evidence.” , „ , „ Air. C. G. E. Harker appeared for both plaintiffs, and Mr. L. AV. AA illis for Davy.
