NEGLIGENT DRIVING CAUSING DEATH
Young Wellington Man Allowed Probation LICENCE CANCELLED FOR THREE YEARS Dominion Special Service. NAPIER. February 22. Found guilty yesterday of negligent driving, causing the death of Harold Claude Russell, at Takapau. Neil David McGoldrick, aged 21, grocer, Hataitai, Wellington, was today sentenced by Mr. Justice Ostler in the Supreme Court in Napier to two years’ probation. The sentence was conditional on McGoldrick taking out a prohibition order and paying the costs of the prosecution, £73/5/10. His licence was cancelled for Three years and a year was allowed in which to pay. His Honour said the only way in which the Court could assist in stamping out these criminal offences was to take a serious view. However, he had been impressed by the good sense of the words of counsel and the good character accused had borne. “I cannot see any real negligence in your case.” said ills Honour. "My impression is that you simply failed to notice that the roai went round instead of going straight on. I am going to takg the unusual course of granting you probation in this case, as counsel suggested, on the conditions laid down by him.”
