PLEA REVERSED

Alleged False Statement To Police HEARING ADJOURNED Permission to change his plea of guilty to not guilty was given John Joseph Sander (Mr. M. G. Neal) when he appeared before Mr. W. F. Stilwell, S.M., in the Magistrates’ Court, ’Wellington, yesterday on a charge of making a false statement to the police on January 7 that his car had been stolen. When the case was called last Tuesday before Mr. J. H. Luxford, S.M.. Sander did not appear, but through his counsel entered a plea of guilty. In remanding accused for sentence on that occasion, the magistrate said the case was far too serious to deal with in his absence. Applying for permission to reverse the plea yesterday, Mr. Neal said that Mr. Hardie Boys, who had represented defendant a week ago, had also appeared for a man named Patrick Joseph Boyle, who had been charged with negligently driving Sander's ear. Without having gone fully into Sander’s case, Mr. Hardie Boys had suggested to Sander that if he pleaded guilty the court would deal more lightly with his friend. The court having taken such a serious view of Sander’s part in the affair, however, and because it was considered that on Investigation he had a good defence, the request for permission to alter the plea to one of not guilty had been made. The magistrate said he proposed to permit. the plea to be amended. Senior-Sergeant D. J. O’Neill, who appeared for the police, asked for a remand, as he said he had not had sufficient notice of tile intention to alter the plea and it would be necessary to call Boyle.
