COURT SEQUEL TO ACCIDENT
..Major Claim Settled In yesterday’s issue, “The Dominion” published under the headings, "Court. Sequel to Accident,” “£1222 Damages Claimed; £36 Awarded,” a report of a case in the Supreme Court before Mr. Justice Ostler. The case was described as one in which damages amounting to £1222/6/- were claimed by Maud Edith Emslie and Basil Bismark Emslie, Ifer husband, against Henry Harold Holwell, a taxi-driver, and Merlin Chamberlain, proprietor of the vehicle. From the report it appeared that when the case was heard Mr. O. C. Mazengarb appeared for plaintiffs and that £36 was awarded against defendants, who were not represented by counsel. Actually the damages awarded by the court were not in respect of the major portion of the claim. When the case was called. Mr. Mazengarb explained that Mrs. Emslie’S claim had been settled out of court, but that there remained a claim by the husband for £2OO for Hie loss of his wife's society and services. In respect of this portion of the claim, defendants were not represented by counsel. After hearing evidence from Mr. and Mrs. Emslie, his Honour stated that as the wife had already received damages in an amount which had not been disclosed to him. tint which he presumed to be substantial, he would award the husband damages at the rate of £1 a week for the 13 weeks from the accident to date, £1 a week for a further 13 ..weeks, and an additional £lO, making £36 in all.
