RETURN OF BOTTLES
Companies’ Application For Injunction DECISION RESERVED The case in which New Zealand Breweries Ltd., E. T. Taylor and Co., Ltd., the Tul Bottling Co., and J MeIlraith and Co., Ltd., asked for an injunction against Agnes Callingham, bottle dealer, was concluded in the Supreme Court, Wellington, yesterday. The Chief Justice (Sir Michael Myers') reserved his decision. Plaintiffs alleged that bottles stamped with the names of the brewers or bottlers had not been returned and had been wrongfully converted to the dealer’s use. The bottles, it was contended, always remained the property of the original owners. Mr. H. J. V. James appeared for plaintiffs, and Mr. J. B. Yaldwyn, with him Mr. M. G. Neal, for defendant. The same four companies, together with the Public Trustee, representing Macarthy’s City and Phoenix Brewery, proceeded against McKendrick Bros. Only the action by New Zealand Breweries was heard, as it was agreed that the decision in that will be binding upon the others.
