, “The new Act is now in force and Hie law was passed in the interests of public safety. It is not in the power of any person, whether be be a Minister of the Crown or anyone else, to waive any provision made by the law,” said Mr. S. L. Paterson, S.M.. in the Rotorua Magistrate's Court to-day. when counsel in a ease of alleged speeding drew attention to the action of the Rotorua Borough Council traffic inspector, acting on instructions contained in a circular issued by the Minister of Transport, Hon. R. Semple, in laying charges against a defendant under the provisions of the Motor Vehicle Act. 1924, instead of under the recently-passed Motor Vehicles Amendment Act. Counsel contended that the offences were made much more serious by the laying of the charge under the main Act instead of under the Amendment Act. In agreeing to amend the charge to bring the information under the Amendment Act, the magistrate slid that the public interest should be dominant but that from his observations Hie new Act was honoured more in the breach titan in the observance.
