Extension of Powers Desired
Argument in support of a petition that a change in the memorandum of assoeia lion of Levin and Company, Ltd., be allowed. was heard by the Court of Appeal, consisting of five judges, yesterday. The company's present principal business is stock and station agency, but they have many other mercantile activities. On the bench were the acting-Chief Justice (Mr. Justice Reed). Mr. Justice Smith. Mr. Justice Johnston. Mr. Justice Fair and Mr. Justice Nortiieroft. Mr. H. E. Evans appeared for petitioners. The company petitioned for confirmation of resolutions passed by sharehold ers to alter the memorandum of association of the company so as to give it power (a) to "undertake and execute, whether alone or in. conjunction with any person or persons in an advisory capacity or otherwise, any trusts of all kinds (other than executors), whether created by deed or by the will or codicil of any deceased person, and to act as trustee or guardbin of any estate or trust funds entrusted to the company, and to per form and discharge all acts and duties pertaining to the ofliee of trustee or guardian”; (b) "to act as agent under power of attorney and to perform and discharge all flu* acts and duties pertaining to the office of attorn'ey.' Judgment was reserved.
