A widow who was left out of her husband’s will affecting an estate of £26,000 sought an order before Air. Hutchison, trustee and legatee, and several other legatees, brothers and sisters, or their dependants. No evidence was called, the issue being confined to legal argument. Counsel for the widow said that the parties were married in 1923 and lived happily till the end of 1926 on a fine property at Reniuera. The husband’s conduct toward her then became such that the wife left him. Later au order for the payment of £lO a week maintenance was made in the Alagistrate’s Court. The husband applied for a
variation and the wife agreed because of the depression, temporarily to accept £5 a week, which was paid till the time of his death. Counsel for defendants admitted that tlie widow should have an allowance, but submitted that it should be ou a reduced basis.
