Case From Carterton An interpretation of the will of the late Henry Robert Bunny, farmer, of Carterton, was given in the Supreme Court in Wellington yesterday by the Chief Justice (Sir Michael Myers), on the application of Francis Charles Bunny, farmer, of Carterton (Mr. C. C. Marsack) and Frederick Haroljl Bunny, farmer, of Wahroonga, New South Wales (Mr. H. H. Daniells). Mr. E. P. Hay appeared for the Public Trustee, the executor of the will of tlie late 11. A. Buuny. I’fae will of the late H. R. Bunny provided £lO.OOO to give the widow an income for life. After her death the capital was to be divided betweey two sons, 11. A. Bunny aud F. C. Buuny. H. A. Bunny died before his mother, without children. The court was asked to decide if his estate was entitled to the money or whether the sum passed to the residue of the estate.
Catherine Mary Mackay (Mr. Daniell) and Clara Cecilia Tatham (Mr. H. R. Biss), parties to the action, did not contest it, agreeing to be bound by the decision of the court.
His Honour held that ou the principles of law, and the wording of the will, the estate of the deceased son took a vested interest in the gift ou the death of the testator, and therefore his estate was entitled to half the capital sum. The residue of the original bequest is £SBBO, so that the sum involved in the action was £4440.
