APPEAL DISMISSED
Verdict For Bank Stands
(Received December 20, 11.45 p.m.)
Sydney, December 20.
The Full Court to-day dismissed an appeal by John Wren, of Melbourne, who had challenged a verdict for £15,225 given against him on a guarantee in favour of the Bank of New Zealand.
The bank claimed £15,225 in respect of a guarantee, the case being heard in April. It alleged that money was advanced to A. C. Cook, Limited, on Wren’s guarantee, and that the whole sum, plus interest, was due and had not been paid. Wren denied the effect of the guarantee, and contended that the bank, without his consent, advanced to A. C. Cook, Limited, an amount in excess of the sum originally stipulated, which was the subject of a cross-action. The jury gave a verdict for the full amount claimed. Wren also failed in his crossaction for £15,225.A stay in proceedings was granted.
