Claim for Damages Fails JUDGMENT ON FACTS Judgment for the defendant, with costs, was given by the Chief Justice, Sir Michael Myers, in the ‘Supreme Court yesterday on a claim for £Bl6 10/- in respect of an alleged refusal to purchase a property in the city in the face of a contract that had been entered into between buyer and seller/ “I find on the tacts that this contract was subject to an o’ral condition. That condition has not, of course, been performed,” said his Honour. Tlie plaintiff was Stephen Hope Reid, contractor, -Wellington, who was represented by Mr. H. J. V. James;' and tlie defendant Robert Richard Holmes, insurance company manager, Wellington, for whom Mr. R. Hardie Boys appeared.
