SUCCESSFUL CLAIM

Full Amount Awarded COLLISION AT HUTT Reserved judgment has been given in the Magistrate's Court in the claim brought by J. C. F. Russell, Limited, against E. G. Shearer, Mr. Stilwell, S.M., finding in favour of plaintiff. The hearing arose out of an accident at Lower Hutt on October 24, when a collision occurred between a motor-van driven by the managing-director of the plaintiff company and a car driven by defendant. Damage was caused to both vehicles, each party alleging that the other was negligent. Plaintiff claimed £93/15/9 and defendant coun-ter-claimed for £BO. In his judgment the magistrate said that he had inspected the scene of the accident and, after hearing lengthy evidence, was satisfied that plaintiff handled his vehicle in a normal and proper manner and that the cause of the accident was the negligent conduct of defendant. Judgment would be for plaintiff for the full amount claimed, with costs, and for plaintiff in respect of the counter-claim. Plaintiff was represented by Mr. 0. C. Mazengarb, and Mr. E. D. Blundell appeared for defendant.
