CLAIM FOR DAMAGES
Injury to Alsatian Dog DECISION RESERVED Decision has been reserved by Mr. E Page, S.M., in the action in which E R. Leighton, of Petone, is claiming from the Tail-Waggers’ Chib of New Zealand (Inc.), and Thomas Charles Webb the sum of £25, the value of an Alsatian dog which had to, be destroyed, because of what was held by the owner to be negligent find unskilful treatment by defendant Webb. Plaintiff was represented by Mr. G. G. Watson. Mr. W. P. Rollings appeared for defendant Webb, and Mr. W. E. Leicester for the defendant club. Addressing the court, Mr. Leicester said that the club was in the unfortunate position of being used as a chopping block In what was virtually a dispute between Webb and Leighton, and between Webb and Crossley, who gave evidence during the hearing of the case. Mr. Leicester submitted that there was no proof that Webb had ever been held out as other than the veterinary adviser to the club. Mr. Rollings contended that the dog s injury had been correctly diagnosed by defendant Webb, and that it had l>een properly treated. Mr. Watson held that the club was liable for negligence in selecting a man as veterinary adviser who had no professional qualifications.
