As a result of the accident, he had been totallyincapacitated for a time. - He had been paid £3/1/7 a week compensation until July 1, but claimed compensation until August 15, after which be had returned to work. , The Harbour Board denied that he was incapacitated after the date of the last payment. After hearing evidence from plaintiff and medical witnesses, Mr. Justice Frazer said that- the court had had some trouble in reconciling Townley’s statements to the medical witnesses,but from "his demeanour in the box thecourt believed his story and gave judgment for 13 weeks’ compensation less the amounts already paid.
