INJURY TO WORKER
Compensation Awarded WATERFRONT MISHAP > Judgment for plaintiff was given oy Mr. Justice Frazer in the Arbitration Court yesterday, in the case in whieh Herbert Turner, waterside worker, claimed compensation for disability arising out of an accident, from Messrs. Ganna way and Co., Ltd., stevedores. Plaintiff was unloading timber, when some fell from the top of the stack, and struck the instep of his right leg, and as other timber was falling. Turner jumped to avoid it. In doing so. he struck /his right elbow on tlie stack nearby, aud thereby suffered injury. The statement of claim set out that plq.utiff was a casual worker, employed by the defendant company, and was en--1 gaged as a wharf labourer. He had suffered temporary tota. disability, and was thereby incapacitated for work, aud would remain so for some indefinite , time. The company had paid compen- : Siltion, for total incapacity to October 15. U«l. Plaintiff claimed a weekly payment for total temporary incapacity for the period of the incapacity. iThe defence admitted all the grounds of claim, but denied that plaintiff had suffered total disability that would continue for an indefinite time. Medical evidence was given that neurasthenia had developed, and the. arm was not yet normal, aud estimated that Turner would nol.be comp etely restored for another three months. Counsel for defendant comjainy thereupon intimated that the company had receded from its previous position, and, in consideration of plaintiff's neurasthenia. would agree to compensation for the period stated in the medical evidence. Judgment was then given for full compensation to the present time, and for a further three mouths. and costs.
