Obtained Relief Work
NOT FALSE PRETENCES
Reserved decision was given in the Lower Hutt Magistrate’s Court yesterday by Mr. W. H. Woodward, S.M., ,who dismissed the charge of false pretences against Nathaniel McKay. The facts were that McKay obtained unemployed relief work by omitting to mention bn the certificate that he possessed over £6OO. Had that fact been known he would not have been able to get unemployed relief. “This man is charged with obtaining money by false pretences,” said the magistrate. "He obtained unemployed relief by means of making a false certificate as to his financial position. “There is no authority on the subject. I have considered the matter very carefully. I have also communicated with Mr. Salmon, S.M. lam of the opinion that in doing what he did the defendant did not obtain money by false pretences. What he obtained was work, and for the money which he did receive he did an equivalent amount of work. "The charge must be dismissed. I do not say some other charge does not lie against the defendant. But this charge doe's not.”
