WIDOW’S ANNUITY

COURT GRANTS INCREASE APPEAL AGAINST WILL An increase in an allowance made to her from her late husband’s estate was granted to Annie Barbara Orr by Mr. Justice Blair in a reserved decision delivered in the Supreme Court yesterday. “After considering all the circumstances,” said his Honour, “I think the widow is entitled to better treatment than she obtains under the will, and although the circumstances do not, in my opinion, justify the full claim she makes, I think she is entitled to a fixed income on a higher basis than is possible under the will.” His Honour ordered that the annuity be increased from £132 to £lB5 a year, with restraint on anticipation, the annuity to be charged on the whole estate with a direction to the trustee to resort to capital for any deficiency in income. A suspensory order was granted in favour of the testator’s only son, John Forbes Orr.
