JUDGE BEEBY’S REOPENING ORDER CHALLENGE TO VALIDITY APPLICATION REFERRED TO FULL HIGH COURT (United Press Association.—By Electric Telegranh.—Copyright.) (Rec. January 3, 8.35 p.m.) Sydney, January 8. Mr. Justice Rich to-day referred into the Full High Court the application challenging the validity of Judge Beeby’s order for the reopening of the coal mines at pre-stoppage rates. The Full High Court bench will sit at Melbourne on Tuesday, and it is likely that judgment on the application will be delivered on the following Monday. NON-UNIONISTS TO MAN TRAINS i THREAT TO WITHDRAW SAFETY MEN Sydney, January 3. The Railway Commissioners have decided to man the trains taking provisions into Rothbury with men who are not members of the union. The Minister of Mines, Mr. Weaver, stated that coal-hewing at Rothbury was now In full swing, and the output was equal to that of normal times. No labourers had left the mine, as had been alleged. A conference of representatives from all the Northern miners’ lodges, held at Cessnock, decided that should the coal proceedings before the Arbitration Court break down, all safety men will be withdrawn from the Northern pits, and’each mine be mass-picketed.
