PARKING LIGHTS
RULES FOR MOTORISTS The fact that one should observe the motor regulations and not the by-law previously iu force was pointed out in the Magistrate’s Court yesterday, when a motorist was prosecuted for parking his motor-car at night without lights. This particular prosecution was laid under the old by-law, which demanded that, no matter where a car was parked, it had to have the parking aiid tail lights turned on. Regulation 3, section IS of the Motor Vehicles Act, 1928, states that ‘‘No person shall be in charge of any motorvehicle, other than a motor-cycle, not having a side car attached, when such vehicle is stationary, >r permit such motor-vehicle to be stationary on auy road unless it displays three lights, viz., a head light or other light, having a beam directed forward from a lamp towards each side of the front of the vehicle, and the tail light desscribed in clause 5 he sol.” That clause, however, does not apply iu the case of a motor vehicle stationary in any place “which is for the time being adequately lighted by a street lamp belonging to a public system of street ligiiting, or would, but for some fa’Tire of such street lamp or street lighting occurring ‘ after the motor-vehicle has been brought to such place lie adequately so lighted.” The motorist pleaded that he was near a light, but the jrosecutioii contended that, even if the defendant had been prosecuted under the existing regulations, his car was parked too far away from any street light to claim the 'benefit of its protection. ••I foresaw a clash coming,” said the .Magistrate (Mr. J. 11. Salmon, S.M.). "ho suggested to he assistant city solicitor (Mr. J. Lockie) that in future cases he should make all prosecutions under the Motor Regulations, aud not under the by-laws. The defendant was fined 10s.
