CLASSIFICATION OF ROADS
_o CASE BEFORE APPEAL COURT. In February last, in the Magistrate’s Court, Mr. E. Page, S.M., dismissed an information brought by the Main Highways Board against N. G. Newman, of Levin, who was charged with driving a motor-lorry on the Horokiwi Gorge and Paekakariki road with a load exceeding the weight-limit allowed on that road. Giving his reserved decision in the matter, the Magistrate held that the power of classification of the roads did not rest with the Main Highways Board, but with the Governor-General, and that accordingly the road in question had never been properly classified. “Under the circumstances,” said the Magistrate, “the information must fail.” In the Court of Appeal yesterday (Mr. Justice Sim, Mr. Justice £>stler, Mr. Justice Blair, and Mr. Justice Smith on the bench) the Slain Highways Board appealed against the decision of Sir. Page. The appellant was represented Iw Sir. E. Currie, and the respondent by Sir. D. Perry. After hearing legal argument from both sides the Court reserved its decision.
