BUILDING BY-LAW CASE
Palmerston North, February 20. The reserved judgment of Air. Justice Ostler in the case wherein the Woodville Borough Council appealed a S? lust the decision of Air. S. L. P. Free, S.AI in dismissing informations for two alleged breaches of their by-laws, was delivered in the Palmerston North Supreme Court this morning. His Honour stated that the appeals would be allowed in both cases, and the matter would be referred to the Magistrate to fix penalties on both.. Defendant bad been charged with erecting a partv wall otherwise than. in accordance with the by-laws, and with (ailing to pull down the wall after due notice. Defendant pleaded not guilty, and after hearing the evidence for. both parties Air. Free dismissed the information’ on December 20. The Woodville Borough Council appealed on a point of law.
