TWO POLLS UPSET
GISBORNE TRAMWAYS HOUSEHOLDERS MAY VOTE BY TELEGRAPH.—PRESS ASSOCIATION. Gisborne, October 7. Ou the ground that a poll should have been taken of. all the electors on the roll, and not of the ratepayers only, the second poll, which resulted in the proposal to discontinue the Gisborne tramways being carried, was upset by Air. Lewy, S.M., this morning. The first poll of the ratepayers was upset on a technical point, and the second was taken last year, resulting in favour of the discontinuance of the trams. A second appeal was then lodged, and the decision on this was adjourned several months ago pending a decision in a case which was believed to have been referred to the Court of Appeal, but which, it has now transpired, w’as not going forward. Tlie ruling of Air. Justice Herdman therefore stood, stated Air. Lewy, that the poll should have been on the general bodv of electors. In this case, therefore, he must find that the poll, being taken on the ratepayers only, was invalid. The Afagistrate allowed £6 6s. costs to the petitioners.
