A BREACH, BUT NO PENALTY. Dominion Special. Auckland, December 16. Mr. Justice Frazer has lecorded * breach of the watersiders’ award, in a reserved judgment on proceedings by the Labour Department for the recovery of a £lO penaltv from Leonard and Dingley, Ltd., stevedores. Defendants had employed two non-union workers on work coming within the scope of the award, but failed to permit them to continue working until work had ceased for the day. His Honour held that the men were entitled to be paid for the whole day, but emphasised that the decision was without prejudice to cases arising at other ports. No penalty would be awarded.
