MERCHANTS GAIN DAMAGES Dominion Special. Dunedin, December 2. Mr. J. R. Bartholomew, S.M., gave his reserved judgment tn the Magistrate’s Court this morning in a case in which Bing, Harris and Co. Ltd., proceeded against Dalgety and Co., Ltd-, on a claim for damages amounting to £54, the value of goods not delivered by the steamer Tainui. The Magistrate held that the conditions in the Otago Harbour Board’s shed led to the reasonable inference that pillage did not occur there, his conclusion being that the case containing the goods was pillaged before it was lauded. He also held that the limitation of liability to claims made within three days was to be treated as a lessening of the liability imposed by the statute, accordingly being null and void. Judgment was given for plaintiff for £54 4s. Bd. and costs amounting to £l2 10s. Security for appeal was fixed at £2O in addition to the amount of judgment and costs of the proceedings.
