PARTNERSHIP DISPUTE
AN APPEAL DISMISSED. Finality was reached yesterday in a lengthy dispute, relating to partnership settlements in connection with the sale of a Wellington business. The case was one in which John Herbert burner, liquidator of K. Alexander and Co., took action against Joseph Bishard Akel. Mr. Justice Ostler gave judgment for Turner, and against this decision Akel appealed. Mr. Justice Sim read the judgment to tho Court of Appeal. . Their Honours held that appellant’s conduct in accepting 'the position of manager of the company's business, and in so acting for several months, was a complete recognition of the company as the owner of the business, and this amounted, in law to a ratification of the agreement which had been made. Tn addition to this conduct, there were also the other acts referred to by Mr. Justice Ostler in bis judgment which helped io establish ratification. Tho appeal, therefore, was dismissed, with costs on the lowest seals. i Mr. A. W. Blair appeared for appellant, and Mr. 11. F. 0 Leary for respondent.
