MOTOR-CAR DEAL
CLAIAI FOR REPAIRS SUCCEEDS. In the Magistrate's Court on Thursday, before Mr. W. G. Riddell, S.M., E. A. Hill, agent, of Palmerston North, claimed from The Dominion Alotors Ltd. £l3 18s. lOd. for repairs to a motor-car and £2O for the loss of the use of the car for three weeks during repairs. Plaintiff alleged that on October 1, 1924, defendant company sold and delivered to him a second-hand motor-car, and it was a term of the sale that the car should be handed over in good running order and properly oiled and greased and filled with petrol Plaintiff took delivery of the car and paid for it, and drove it towards Palmerston North. When near Palmerston North the car broke down, owing, it was alleged, to the seizing of certain parts, due entirely to the car not Being properly oiled After hearing the evidence of a number of witnesses, the Alagistrate held that plaintiff had established his case, and that it was a.term of the sale that the car was to be properly oiled and greased, and that had not been done, with the result that the ear had broken down. The claim for file loss of the use of the car was disallowed, but judgment was entered for plaintiff for the cost of the repairs, with costs. At the hearing Air. J. S. Hanna appeared for plaintiff and Air. D. R. Hdggard for defendants.
