HOUSE PROPERTY DEAL

CLAIM FOR RETURN OF DEPOSIT FAILS. A dispute concerning the purchase of house property was inquired into by Mr. AV. G. Riddell. S.M., at the Magistrate’s Court on Thursday. The parties concerned were AVilliam Stevenson, freezing works employee, who proceeded against A. Nicol, of Pahautanui. for the return of £75 deposit paid in respect of the purchase of a house. Plaintiff alleged that on August 8, 1921, defendant agreed to sell the property, No. 33 Edinburgh. Terrace," for £575. On August 8 plaintiff paid to M. I. Mitchinson, as agent for the defendant, £75 as deposit. Prior to tho agreement,' plaintiff inspected another property belonging to the defendant. No. 35 Edinburgh Terrace, with a view to purchase, but defendant sold this property. Plaintiff further alleged that defendant’s agent. Mitchinson. then falsely represented to plaintiff that the property at No. 33 was exactly the same in all respects as that nt No. 35. Such representation, plaintiff alleged, was false, ns No. 35 was a greatly inferior property, was infested with borer, did not contain the same conveniences, nnd was defective in other respects. He therefore claimed the return of the £75 deposit. Mr. AV. Perry appeared for the' plaintiff, and Mr. AV. F. AVnrd for the defendant. After hearing the evidence. His AVorship said that the plaintiff had failed to make good the allegations in his statement of claim. 1 Judgment would be for the defendant, with costs.
