JUDGE UPHOLDS COMMISSIONER. BY TEr.EGBAPH— PRESS ASSOCIATION. Dunedin, March 2. Mr. Justice Sim delivered judgment this morning in the case Dunedin Starr-Bowkett Society v. the Minister of Stamp Duties. The question at issue was whether a principal sum secured by mortgage to the society w:v £lOO or' £125, the latter being the sum advanced and the premium thereon. The Commissioner had assessed £125 for stamp duty. The Judge said that the payment of the premium was not optional, and could not be regarded as in tho nature of interest. It was properly treated as principal. The assessment was confirmed.
