QUESTION OF WELDING
APPEAL FROM MAGISTRATE’S DECISION.
An appeal from the judgment of a Magistrate at Masterton was heard in the Supreme Court on Monday by His Honour the Chief Justice (Sir Robert Stout) The appellant was Charles Bennett (Mr. H. C. Robinson), and the respondent, the Wairarapa Combined Motors (Mr. H. R. Biss)-. It was stated that the respondent firm had done motor repair work fir Bennett who had disputed the amount of tho account, and had denied any °o‘tS a " tion for the amount charged. the Magistrate gave judgment against him far JA69 18e. Id., and the decision was the subject of the appeal. _ Allegations that the repair werk to the appellant’s motor-car had not been carried oiit properly were made by Mr Robinson, for the appellant. He quoted law on the point. "Where there is a proper method qnu an inferior method,” said His Honour, "a skilled workman is bound to use the proper one. That is ordinary law Mr 'Robinson: We suggest that the ordinary law was not “PP ll^^ the Magistrate.” Counsel added that leave to hear further evidence had been given, as the case had been left bare previously of evidence respecting acetone-welding, which had been employed on the motorcar. lie proposed to call evidence.
