The Court of Appeal yesterday heard an appeal by H. Malson and Co., ot Christchurch, auctioneers nnd land and estato agents, against an order (made in the Supreme Court by Mr. Justice Donn'iston) about an award by William Tyers, public accountant, who arbitrated upon tho disposal of an interest under the will of tho late J. S. Hooper, lho appellants wero defendants in the bupronie Court case, which was brought by lieorge Fisher (grandson of Hooper) and his wife, Alice I'ishor. Fisher moved (hat the award of 'I'i'crd be adopted, and the Court made an order accordingly. Yesterday it was alleged for tho appellants that they had suffered a grievance from the way in which the arbitrator had dealt with some of (lie matter submitted to him. It was not so much tho amount involved as a feeling on the part of tho appellants that they liad not had .their legal rights upon tho question of interest. Mr. C. P. Skerrett, Mr. 0 T. J. Alpers appeared for the appellants, and Mr. H. J. Beswick for tho respondents. The Chief Justice (Sir Robert Stout), Mr. Justice Cooper Mr. Justice Chapman, and Mr. Justice ±los - ing occupied the bench.
