In a. recent case against ono Michael Joseph Bosne'y,, who was charged at Fitzroy, Sydney, recently with having tailed to send in a .Federal mcDme tax return for tho year onding .luno 30, the prosecution 6aiu: that defendant had not sent in a roturn for 1916 or for the previous year. Ho bad only been traced by officials of tho Department searching through Tattersall's list. ■ - • Defendant said he did not send ill a return because .his earnings for tho year did not total ,£156, and he had not understood that a cash prize in Tattersall's should be included in a roturn. It was en illegal lottery, .and therefore the Government he Ihought, should not take that into account. The fact that he would havo to include tho prize be won never entered his head. The Police Magistrate said a cash prize in a lottery was specifically included in the Act. ' , , . .. Defendant: If that js to, what is the position of a man who includes money which he admits is obtained through an illegal lottery? , , The Magistrate: Don't yon. worry about that; yon are not likely to wm .nither TattersftU'e prize.
