SUPREME COURT

A WIDOW'S CLAIM His Honour Mr. Justice Hosking presided over tho civil sittings of the Supremo Court yesterday. Hilly M'Daren, wife of Private Andrew M'Laron, deceased, claimed from the Railway Department the sum of £1000 damapes for her husband's death. Mr. P. Levi appeared for tho plaintiff and. Mr. P. S. K. Maoassey for the Department. The statement of claim alleged that tho deceased was .returning to Trentham Camp by rail on' April 28. With tho intention of proceeding to an adjoining carriage, ho opened a door, which was not locked, and- stopped out. There was no platform, and the deceased fell between the carriages, and was killed. Plaintiff contended that the accident, was due to tho negligence of the Department in havingno platform on the carriage or in not having the door locked to prevent anyone doing what the deceased did. It was contended for the Department that the deceased, in leaving his seat, disobeyed an order which prohibited «oldiers from passing from one carriage to another. It was also alleged that tho deceased was. under tho influence, of liquor. , ~ - , When the case had been partly heard, tho Court adjourned.
