O'Lcary appeared. procee<le<l against Samuel Triestor and Co., hat and tap manufacturers, to recover £\S 55.,' made up of .Ell 159. alleged damage to a bilhardtablo cloth and M 10s. loss incurred through not being able to let the bil-liard-tablo for a day and a half. Mr. D. Jackson appeared for the defendants. According to '.ho ovidonco tho partiee irere tenants in tho samo building, tho defendants occupying tho floor above tho billiard saloon. On tho afternoon of ■Tuno 5 last some water' upset on defendnnts' floor oamo through and fell on the billiard-tnblc, causing the damage alleged. Plaintiff ivont upstairs and eaw Trieeter, who 6aid that a girl had upsot tho water and must pay for tho damage. I'or tho defence it was contended that, tho damaßO was not'as great iis alleged, ant! that the old cloth could havo been renovated nnd replaced.
