NOTICE LS HEREBY GIVEN that it, is tho intention ol' the Wellington City J Council to introduce iu tho onsurug Session of Parliament, tho Wellington City 1 Trading Departments' Reserve and Rcncwi al Funds Bill. Tho objeots that tho baid - Bill is intended, to effect ore:— 1 1. To provide that tho Council may establish ronowal funds iu connection with the Abattoir Undertaking, the Tramway and Power Supply Undertaking, and the Electric Light and Tower Supply Undertaking. 2. For tho punpose of such funds In compiling the annual accounts of revenue and expenditure of such, undertakings 'to charge on annual appropriation to ■provide renewal funds. Such appropriation to he : one pound ten shillings per centum of tho Taluo, o£ the depreciable assets of tho ' undertaking, and such value to be fired by tho ,Oity Engineer, whoso decision shall bo final. \ 3. To provide that such appropriations .shall be made independently of charges for maintcnanco s and repairs. 4. To provide that such appropriations ; shall bo paid in-.tho month of April in each year to Commissioners to bo appointed under tho Act; tho first of such payments to ho made in April, 191s5. To provido that three Commissioners, to bo termed "Tho Wellington City Renewal Fund Commissioners," shall be nipproved on tho passing of tho Act, and that tho provisions of Sections 35, 36, and 39 of Tho Local Bodies' Loans Act,_ 1910, shall, mutatis mutandis, apply aa if tho Commissioucra were appointed under that Act. 6. To provido tho.t, the Council shall transfer tho existing Abattoir Renewal Fund, amounting to £2171 Oa. Id., una tho existing Tramway Renewal Fund, amounting to £32,078 Bs. «d.. to tho Ooromission- . era to bo so appointed. V. To provido that the Commissioners shall invest, all moneys in: (a) Now Zealand Government, securities. (b) On deposit i'n any bank carrying on business in Now Zealand, undeituo authority of an Act of tho General Assembly. 8. To provido that separate acounlß Khali be kept by tho Commissioners in respect of tho soveral undertakings. 0. To provide that, all moneys, together ■with all accumulations or interest, shall bo held by tho Commissioners on trust to pay to the Council the portion of tho .funds, standing to tho credit, of each such undertaking, for tho purposo of renewing or replacing the plant, of! tho undertaking or any part or parts thereof that m<iy from time to lime become worn ; oiil, obsolete, or incapable from any other eause.of further usefulness. 10. To provide (1) That every demand mado by the Council, on tho Commissioners shall bo accompanied by a- copy of tho resolution of tho Council calling up suoh moneys, and by a full specification of the work 6 .proposed to be done. (2) Such rosolntion must stale.that Ute money proposed to bo called up iu required to replace, plant or material that has become worn nut or obsolete, or is incapable from any other cause of further usefulness, and shall bo certified by tho Mayor and the Town Clerk. (3V Thai the Commissionars shall not pay or refund, in respect of any undertaking any amount in excess of tho amount, hold by thorn io file, credit, of such, undorlaking. 11. To provide that, tho Commissioners may call for a. report by an engineer or other qualified person as to the propriety of any demand mado upon them; that such person shnll have tho right io incjuiro into tho reasons why the Council proposes to expend tho moneys asked for and into the nature and extent of t.hn proposed works; that such engineer' 1 shall report to t.ho Commissioners the result of. hip investigation and his opinion on tho proposals; and that tho Commissioners may pay suoh person a. reasonable sum for his services. 12. To provide that the Commissioners may pay tho amount demanded by instalments, or may decline to pay such money; that in tho lati--,r case tho Council may by summons iu Chambers apply to tho Supreme Court for an order dirocl.ing tho Commissioners to pay llio sum demanded; that if the Court is of opinion that tho Council ha« proved that the money required is uecess«.ry to replace or renew plant which has become worn out or obsolete, or incapable from any other cause of further .usefulness, tho Court may order the •payment of tho money io tho Council; and that tho decision of the Supreme Court shall ho linal. 13. To provido that if on the maturity of any debentures the Sinking Fund is insufficient to pay tho debentures, tho Council may call up tho Renewal Fund in tospeot of which the debentures were ißsned; that the Commissioners may pay- tho amount so domanded or may call for a report on tho financial bearing of the Council's demands, aud that tie provisions- of Sections 10 and 11 of the Bill (being thoso summarised in paragraphs 11 and 13 of this notice), shall apply, mutatis mutandis, to such demands. 14. To provido (1) That tho Council may establish Kescrvo Funds in respect of tho Tramway and Power Supply Undertaking, and in respect of tho Electric. Light and Power Supply Undertaking: (2) That tho Council shall charge against tho accounts of snnh nn-' ' dcrtaking an annual appropriation, of one pound ten shillings ipeicentum of tho deprecia.blo assets of such undertakings.' W That, tho moneys paid into suoli accounts shall bo applied for such extensions and improvements in the. undertaking in connection with which tho fund is established as the Council thinly fits. (5) That, if at any timo tho renewal funds created in respect of cltJicr the. Tramway and Power Supply Undertaking, or in rcsiuect of the Electric Light and Power Supply Undertaking, shall bo insufficient to meet renewals, tho Council may use any part of tho reserve fund established for fho undertaking requiring further rcnowals, for tho purposes of such renewals. (6) That the Council must invest such rcscrvo funds ' (a) In New Zealand Government securities. (b) On deposit in any Bank carrying on business within New Zealand under the authority of an Aot of the General Assembly. 15. To provido (1) That the Council may establish Accident Funds iu connection with the Tramways and Power Supply Undertaking, and in connection with the Electric Light and Power ' Supply Undertaking. (2) That such funds may lie iisort to meet claims for accidents arising in connection with the Undertaking for which tho fund is established. (3) That tho Council may invest.such funds on deposit in any Bank can-ying on business in New Zenland'Under tho authority cf an Aot of tho General Assembly. A copy of this Bill has been de- . posited in tho Magistrate's Court ' Office. Lambton Quay, Wellington, and a copy of the said Bill ta.B [ also been deposited at tho Town Clerk's Office, Town Hall, Cuba Street.
