.— <> A WATERSIDEE'S CLAIM. His Honour Mr. Justice Hosking and a jury of i'our heard on Saturday a claim lor ,£501) damages, The plaintiff was John Henry White, of Wellington, waterside worker, and the defendants were Itichardson and Co., Ltd., of Napier. Plaintiff, in his statement of claim, alleged that ho received injuries duo to the negligence- of a fellow servant in common employment with himself. On .November i! 0, 1916, he was assisting to discharge cargo from tho defendants' steamship Eipple. A "dump" of. sheep-skins was about to bo raised, and plaintiff, in the proper exercise of his duty, signalled to easo it gently before raising it. I]he batchman .:onveyed the sigacil to the winchman, but the latter disregarded it, and tho load, swinging violently towards plaintiff, jammed him against a stanchion and broke his right fore-arm. Since the accident, plaintiff had been unable to do work of any kind, and he was adyised that his disability would continuo indefinitely, that tho arm would always be more or less disabled, and that it was permanently deformed. Defendants contended that the accident was either a pure misadventure or was caused by plaintiff's own neglect in not standing clear of pos ß^0 injury, or in not handling the dump carefully and efficiently. Mr P. J. O'Regan appeared for tiff, and Mr. C. P. Skerrett and Mr. T. W. Hislop for the defendant company. Tho case was not quite concluded when the Court rose. It will be continued to-
